Appeals and legal procedures

When a decision by the authorities is wrong, we assess whether it can be appealed, by when and on what grounds.

What we do

  • Written objections when you are given the chance to respond (trámite de audiencia)
  • Appeals for reconsideration (recurso de reposición) and hierarchical appeals (recurso de alzada)
  • Claims before the economic-administrative tribunals
  • Appeals against refusals by the immigration authorities
  • Responding to requests from the Public Employment Service (SEPE)
  • Written submissions and applications to any public authority
  • Resolving issues with the Social Security and the National Social Security Institute (INSS)
  • Following the case through to a decision

Deadline, procedure and authority

The first thing we look at is the notification: what has been decided, who decided it, what appeal is available, where it must be filed and the last day for doing so. If the deadline is about to expire, we tell you straight away and give the appeal priority.

We then examine the grounds under the law in force on the date of the events and the documents you have, and tell you frankly whether we think you have a case. If the outcome is uncertain, the head of the relevant area reviews it before we recommend anything.

Do not wait until the last minute: with the notification in hand, we can quickly tell you how long you have and what to do.
